Many people will obtain a copy of their credit report and feel a sense of relief when they see that a certain debts have been charged off.  This sense of relief comes from their understanding that once a creditor decides to charge off  a debt that they can no longer pursue it.  So, a charged off debt means no more collection calls and certainly no more risk of being sued, right?  Not right.  In fact, it is totally wrong.

When I am not working as a bankruptcy attorney or fighting debt buyers like Midland Funding in court a lot of my time is spent working on my hobby farm.  Right now we have about 20 chickens and a few cattle.  Chickens for the most part are mindless birds who do things like eat their own eggs, poop everywhere, and flee at the slightest sense of danger (being that low on the food chain must be stressful).

I have noticed that when I go out to feed them they will come running up to me, but if I get too close they will bend the legs and flex  their wings slightly and generally appear to be bracing for total destruction.  It is as if they have processed in their chicken minds that the end is near, it is too late to run, so I might as well close my eyes and wait for the worst.  I haven’t killed any of my chickens (at least not on purpose), so after a few seconds they realize nothing is going to happen and they jump up and run off.

Once the initial shock and panic of being sued by a debt buyer wears off you probably have thought to yourself, “now what in the world do I do!?”  Well, as I have mentioned in prior articles, you must act.  Doing nothing will result in wage garnishment and all kinds of additional financial problems.  If a debt buyer has sued you, your first step is to put together a response to their complaint.

Before we get into the nitty gritty of how you actually draft your response it is helpful to go over what various documents contain and what they are called.  At this stage you likely have two documents, the Complaint and Summons:

Summons:     The Summons is the document that should have been served on you by the process server when they originally dropped off the lawsuit.  This document is important because it will tell you exactly how many days you have to submit your response to the court.  Once you get the Summons make sure you write down on your calendar when the deadline is to respond.  You don’t want to miss this deadline!
